Terms & Conditions

These Terms and Conditions govern your use of the Extra Power Gym website, memberships, facilities and services.

Introduction

These Terms and Conditions (“Terms”) govern your use of the Extra Power Gym website, membership enquiries and online registrations, gym memberships and day passes, personal-training and group-class bookings, promotional offers, and your use of Extra Power Gym’s facilities and services.

“Extra Power Gym,” “we,” “us” and “our” refer to Extra Power Gym, Al Yasmeen, Ajman, United Arab Emirates.

“Member,” “you” and “your” refer to the person accessing our website, purchasing a membership or using our facilities.

By using our website, submitting a membership application, purchasing a service or entering our facility, you confirm that you have read and agreed to these Terms.

Nothing in these Terms limits any mandatory rights available to consumers under applicable UAE law.

Eligibility

You must provide accurate, complete and current information when applying for membership.

Members must satisfy our applicable minimum-age requirements. A person under 18 years of age may be required to:

  • Obtain written consent from a parent or legal guardian.
  • Have the membership agreement signed by the parent or guardian.
  • Follow additional supervision and access restrictions.
  • Provide any health clearance reasonably requested by the gym.

We may request an Emirates ID, passport or another valid identification document to verify identity and age.

Membership may be refused where reasonably necessary for safety, legal compliance, previous serious misconduct or unpaid amounts.

Membership Plans

Available membership plans, benefits, prices and validity periods will be displayed on our website, at reception or in official Extra Power Gym promotional materials.

Membership options may include:

  • One-day access
  • Monthly memberships
  • Three-month memberships
  • Six-month memberships
  • Annual memberships
  • Personal-training packages
  • Group-class packages

The services included in each plan will be those stated at the time of purchase.

A membership does not include personal training, specialist classes, products or other chargeable services unless expressly stated.

Prices and VAT

All prices are shown in UAE dirhams.

Unless expressly stated otherwise, applicable UAE Value Added Tax will be added to the displayed price.

Members will receive an invoice or receipt containing the required transaction information.

Extra Power Gym may revise its prices from time to time. A price change will not normally affect a fully paid, active fixed-term membership until that membership expires, unless required by law or agreed with the member.

Payments

Payment must be made using a payment method accepted by Extra Power Gym, which may include:

  • Cash
  • Debit or credit card
  • Approved online payment
  • Bank transfer
  • Another method displayed at reception or on our website

Membership will not be activated until the required payment has been successfully received.

If a payment is reversed, declined, disputed or remains unpaid, we may suspend access until the matter is resolved.

Members must not make personal-training or membership payments directly to an individual trainer unless Extra Power Gym has expressly authorised that payment method.

Membership Activation and Validity

A membership normally begins on the activation date stated in the membership record or invoice.

Membership periods run continuously from the activation date, including weekends and public holidays, unless the applicable plan expressly states otherwise.

Unused days, sessions or access periods do not automatically extend a membership.

A day pass is valid only for the date or visit for which it was issued and cannot normally be carried forward.

Members are responsible for checking the activation and expiry dates shown on their receipt or membership profile.

Opening and Promotional Offers

Opening offers, first-week offers and other promotions:

  • Are available only during the stated promotional period.
  • May be limited to a specific number of memberships or “limited slots”.
  • Are subject to availability.
  • Cannot normally be combined with another offer.
  • Have no cash value.
  • May be restricted to new members or selected plans.
  • Must be paid for within the promotional period.
  • Remain subject to the specific conditions stated in the advertisement.

Extra Power Gym may end a limited-slot offer once the allocated memberships have been sold.

We will honour confirmed purchases made under a valid offer, subject to payment completion, these Terms and applicable UAE law.

Renewals

A fixed-term membership ends on its stated expiry date unless it is renewed.

Membership will not be automatically renewed or charged unless:

  • Automatic renewal was clearly disclosed.
  • The member expressly authorised it.
  • The arrangement complies with applicable law and payment-provider requirements.

Renewal prices and promotions may differ from the member’s original purchase price.

Cancellation and Refunds

Membership cancellation and refund requests must be submitted to Extra Power Gym in writing.

Eligibility for a cancellation, refund or credit will depend on:

  • The membership plan purchased.
  • Whether the membership has been activated or used.
  • The reason for the request.
  • Any supporting documents.
  • The conditions disclosed at the time of purchase.
  • Applicable UAE consumer-protection law.

Promotional, discounted, partially used and short-term memberships may be non-refundable except where a refund is required by law or approved by management.

Approved refunds will normally be returned through the original payment method. Payment-provider or bank processing times may apply.

Failure to attend the gym, personal relocation, a change in personal schedule or a change of mind does not automatically create a right to a refund.

Nothing in this section removes any refund, remedy or compensation right that cannot legally be excluded under UAE law.

Membership Freezing

Membership freezing is not automatic.

Where freezing is offered, it may be subject to:

  • A written request
  • Management approval
  • A minimum and maximum freezing period
  • Supporting medical or travel documents
  • An administration charge
  • A limit on the number of freezes
  • The rules applicable to the purchased plan

Promotional, day-pass and short-term plans may not qualify for freezing.

A membership is not considered frozen until written confirmation has been issued by Extra Power Gym.

Membership Transfer

Memberships are personal and may not be shared, sold, transferred or assigned unless Extra Power Gym gives written approval.

Members must not allow another person to use their membership card, QR code, biometric record, access credential or account.

Unauthorised sharing may result in suspension or cancellation without prejudice to other rights available to the gym.

Gym Access

Members must:

  • Use their authorised access method.
  • Present identification when reasonably requested.
  • Enter only during permitted operating hours.
  • Follow staff and trainer instructions.
  • Use only areas included in their membership.
  • Wear suitable clothing and footwear.
  • Leave the premises by closing time.

Access may be temporarily restricted because of maintenance, repairs, safety issues, private events, capacity limits, government requirements or other operational reasons.

Opening hours may change during Ramadan, public holidays, maintenance periods or exceptional circumstances.

Health Declaration and Fitness to Exercise

Exercise carries an inherent risk of injury.

Before exercising, members must disclose any medical condition, injury, pregnancy, physical limitation or other matter that may affect safe participation.

Members are responsible for seeking advice from a qualified medical professional before beginning or changing an exercise programme where appropriate.

You must stop exercising and immediately inform a trainer or staff member if you experience:

  • Chest pain
  • Dizziness
  • Faintness
  • Unusual shortness of breath
  • Sudden weakness
  • Severe pain
  • Any other concerning symptom

Extra Power Gym and its trainers do not provide medical diagnosis or medical treatment.

A trainer may stop or modify an exercise where they reasonably believe that continuing may be unsafe.

Equipment Use and Safety

Members must:

  • Complete an induction where required.
  • Use equipment only for its intended purpose.
  • Follow the displayed instructions.
  • Request assistance if unfamiliar with equipment.
  • Use safety clips, guards and supports where applicable.
  • Return weights, dumbbells and accessories after use.
  • Avoid dropping weights unnecessarily.
  • Keep walkways and emergency exits clear.
  • Wipe equipment after use.
  • Report damaged equipment immediately.
  • Never use equipment marked “Out of Service.”

Members must not attempt to repair, modify or move equipment without authorisation.

Gym Conduct

Members and visitors must behave respectfully toward other members, employees and trainers.

The following are prohibited:

  • Smoking or vaping
  • Alcohol or illegal drugs
  • Unauthorised injections or prohibited substances
  • Selling or sharing prohibited substances
  • Violence, threats, harassment or discrimination
  • Sexual harassment or inappropriate physical contact
  • Abusive, insulting or intimidating conduct
  • Unsafe or reckless exercise
  • Intentional damage to property
  • Unauthorised commercial activity
  • Unauthorised personal training
  • Recording another person without permission
  • Any unlawful activity

Extra Power Gym may warn, suspend or remove a person whose behaviour is unsafe, unlawful, disruptive or contrary to these Terms.

Serious misconduct may result in immediate termination and referral to the relevant authorities.

Personal Training

Personal-training services are subject to trainer availability and separate pricing.

Members must book and pay for personal-training sessions through an authorised Extra Power Gym channel.

Cancellation and rescheduling requirements will be communicated when a session is booked. A session cancelled late or missed without sufficient notice may be treated as used, subject to applicable law and the circumstances.

A specific trainer cannot be guaranteed. Extra Power Gym may assign a replacement trainer when reasonably necessary.

Group Classes

Class schedules, instructors and formats may change.

Class spaces may be limited and allocated according to the applicable booking process.

Members should arrive before the class begins. Late entry may be refused where it could cause disruption or create a safety risk.

A class may be cancelled because of low attendance, instructor unavailability, maintenance, safety concerns or circumstances beyond our reasonable control.

Lockers and Personal Belongings

Lockers are provided for temporary convenience, subject to availability.

Members must:

  • Use only the locker allocated or selected for their visit.
  • Secure the locker properly.
  • Keep the locker key, code or access credential safe.
  • Remove belongings before leaving.
  • Avoid storing prohibited, dangerous, perishable or unlawful items.

Unless a specific long-term locker arrangement has been approved, lockers must not be used for overnight storage.

Members should avoid bringing unnecessary valuables. To the maximum extent permitted by law, Extra Power Gym is not responsible for unattended, unsecured, lost or stolen personal belongings unless the loss directly results from the gym’s proven negligence or unlawful conduct.

Photography, Video and Social Media

Members must not photograph or record another person without their permission.

Photography is prohibited in:

  • Changing rooms
  • Toilets
  • Shower areas
  • Any other designated private area

Commercial photography or filming requires prior written approval.

Extra Power Gym will seek appropriate consent before using an identifiable member’s image for advertising or promotional purposes.

CCTV may operate in suitable public areas for safety and security in accordance with our Privacy Policy.

Temporary Closure and Service Changes

Extra Power Gym may temporarily close or restrict all or part of the facility because of:

  • Essential maintenance or repairs
  • Equipment installation
  • Safety or security concerns
  • Utility interruption
  • Government directions
  • Public-health requirements
  • Events beyond reasonable control
  • Other legitimate operational needs

Where reasonably possible, advance notice will be provided.

Damage to Property

Members may be responsible for damage caused by their deliberate act, misuse, negligence or failure to follow instructions.

Normal wear and tear will not be charged to a member.

Extra Power Gym may recover reasonable repair or replacement costs where responsibility is established.

Suspension and Termination

Extra Power Gym may suspend or terminate membership where a member:

  • Fails to pay an amount due.
  • Provides false information.
  • Shares membership access.
  • Seriously or repeatedly breaches gym rules.
  • Harasses or endangers another person.
  • Damages gym property.
  • Uses or distributes prohibited substances.
  • Conducts unauthorised personal training or business activity.
  • Engages in unlawful conduct.

Where appropriate, we may issue a warning and provide an opportunity to correct the breach.

Serious safety, harassment, violence, drug or criminal matters may result in immediate suspension or termination.

Limitation of Liability

Extra Power Gym will take reasonable steps to maintain a safe environment and properly maintained equipment.

However, members acknowledge that physical exercise involves inherent risks, including strains, falls, equipment-related injuries and aggravation of existing medical conditions.

To the maximum extent permitted by law, Extra Power Gym is not responsible for injury, loss or damage caused by:

  • Failure to disclose a relevant medical condition.
  • Ignoring instructions or warning signs.
  • Incorrect or unauthorised use of equipment.
  • Exercising beyond personal capability.
  • The deliberate or negligent conduct of another member.
  • Unsecured personal belongings.
  • Events outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights or liability arising from proven negligence, fraud or intentional misconduct.

Website Use

You may use our website only for lawful personal purposes.

You must not:

  • Attempt to gain unauthorised access.
  • Introduce malware or harmful code.
  • Disrupt website operation.
  • Copy or exploit website content commercially without permission.
  • Submit false or misleading information.
  • Impersonate another person.
  • Use automated systems to misuse our services.

We may suspend or block website access where misuse is detected.

Website Information

We take reasonable care to keep website information accurate. However:

  • Class schedules may change.
  • Trainer availability may change.
  • Images may be illustrative.
  • Temporary website errors may occur.
  • Offers remain subject to their stated availability and conditions.

If an obvious pricing or technical error occurs, we may correct it and contact the affected customer before processing or completing the transaction.

Intellectual Property

The Extra Power Gym name, logo, website design, photographs, videos, graphics and written content are owned by or licensed to Extra Power Gym.

They may not be copied, reproduced, modified, distributed or used commercially without prior written permission.

Third-Party Services

Our website may contain links to payment providers, maps, social-media platforms or other third-party services.

Third-party services are governed by their own terms and policies. Extra Power Gym is not responsible for third-party content or systems, except where responsibility cannot legally be excluded.

Privacy

Personal information is handled in accordance with our Privacy Policy and applicable UAE data-protection requirements.

By using our website or services, you acknowledge that personal information may be processed as described in the Privacy Policy.

Changes to These Terms

We may update these Terms to reflect changes in our services, membership arrangements, operating procedures, website functions or legal requirements.

Updated Terms will be published with a revised “Last updated” date.

Material changes affecting an existing paid membership will be communicated where reasonably required and will not remove rights already acquired under applicable law.

Complaints

Members should first submit complaints to Extra Power Gym so that we can attempt to resolve them promptly.

Please provide:

  • Your full name
  • Membership number
  • Contact details
  • Details of the issue
  • Relevant dates
  • Supporting documents or receipts

If a consumer complaint cannot be resolved directly, the consumer may contact the competent consumer-protection authority in Ajman or the UAE Ministry of Economy and Tourism.

Governing Law and Jurisdiction

These Terms are governed by the applicable laws of the United Arab Emirates and the Emirate of Ajman.

Subject to applicable consumer rights and jurisdiction rules, disputes will be submitted to the competent courts of Ajman, United Arab Emirates.
